Minneapolis Woman File-Sharing Trial Set

Jammie Thomas-Rassett, the Minneapolis woman whom has been charged with illegal downloading and file-sharing through the use of KazAa, is scheduled for to stand before trial for the Third time, October 4th, 2010. Thomas-Rasset has been found guilty twice now of using the Peer-to-Peer network to illegally download and share music. She originally was sentenced to pay $9,250 per work (24 Counts), totalling $222,000. After appeal, She again was found guilty and instead was sentenced to pay $80,000 per infringed work, totalling $1.92 Million! Judge Michael Davis found that the sum awarded by the second jury was "monstrous and shocking" and is proposing the maximum amount the jury could award would be $2,250, totalling $54,000.

The Labels included in the case, had offered a settlement of $25,000 to be donated to a major charity this past January. Thomas-Rasset declined. Her Attorney stated that Thomas-Rasset would not accept an offer "that requires her to pay monies to or on behalf of the Plaintiffs."
